Stage 6 of 7
Product compliance and trademark registration by market
Tests, labels, responsible persons and trademark filings for the markets you sell in, planned before stock is ordered. General information here; each project is checked with licensed specialists.
Product compliance and international trademark filing, planned together
Product compliance for a new brand means establishing which rules apply to your product in each target market, then arranging the tests, documents, labels and responsible persons before goods ship. Trademark filing protects the name in those same markets. We handle both in one stage, because the label, the packaging and the sales plan depend on both.
A brand owner should understand one thing early: selling under your own name usually makes you responsible as if you had made the goods. Under the EU General Product Safety Regulation, applicable since 13 December 2024, a company placing a product on the market under its own name or trademark is treated as the manufacturer, and a consumer product needs a responsible economic operator established in the EU. A contract with a factory does not remove these duties.
So we do not say that we take over your compliance. We map the requirements, organise laboratories and specialists, prepare the file and check labels. Legal opinions come from licensed attorneys and consultants. See the rules by market and by category.

What a product typically needs in the EU and US
Starting points, not a complete list. National rules and specific product types can add requirements.
| Product type | Starting point | Check first |
|---|---|---|
| EU: general consumer goods | General Product Safety Regulation (EU) 2023/988: risk analysis, technical documentation, traceability details, EU responsible person | Whether a specific sector law applies instead |
| EU: toys | CE marking under Directive 2009/48/EC. Regulation (EU) 2025/2509 replaces it from 1 August 2030 and adds a digital product passport | Age grading, and whether the item legally counts as a toy |
| EU: cosmetics | Regulation (EC) 1223/2009: EU responsible person, product safety report, CPNP notification | Claims that could make it a drug or medical product |
| EU: clothing and textiles | Regulation (EU) 1007/2011: fibre composition label in the language of the country of sale | Children’s wear, chemical restrictions |
| EU: electrical and electronic goods | Depending on the product: LVD 2014/35/EU, EMC 2014/30/EU, RoHS 2011/65/EU, RED 2014/53/EU; declaration of conformity, technical documentation, CE marking | Radio functions, batteries |
| EU: food contact items | Regulation (EC) 1935/2004, with a written declaration where a specific measure requires one, such as for plastics | Material and intended use |
| EU: food and supplements | Regulation (EU) 1169/2011 on food information; Directive 2002/46/EC for supplements; national steps vary | Ingredients permitted in the target country, health claims |
| US: children’s products | Children’s Product Certificate based on testing by a CPSC-accepted laboratory | Whether the item counts as a children’s product |
| US: cosmetics | MoCRA: facility registration, product listing, safety substantiation records | Who the label names as responsible |

Compliance mistakes found too late
Claims added by marketing
A single phrase about health or safety on the pack can move the product into a stricter regime.
Labels printed before the check
Missing or wrong mandatory text means relabelling, or goods that cannot be sold.
No responsible party in the market
Selling into the EU without a responsible operator can block sales and marketplace listings.
Frequently asked questions
Do you guarantee that my product passes testing or inspection?
No. We organise testing and review so that problems surface early, but laboratories and authorities decide. If a product fails, the gate decision applies.
What is an international trademark filing?
Under WIPO’s Madrid System, you file one international application based on a home application or registration and choose member countries. Each national or regional office then decides under its own law. An attorney advises whether this or separate national filings suit you.
Does an EU trade mark cover all EU countries?
Yes, an EU trade mark is valid throughout the EU. However, an earlier right in a single country can be enough to oppose the application, so a search before filing matters.
Who is responsible if a factory made the goods?
Under EU rules, the brand owner is generally treated as the manufacturer, and importers have duties of their own. A factory contract can give you recourse without removing these duties.
Have a product idea? Check it before you buy stock.
Send a short brief. We tell you what we think, including when we think you should not do it.

- No obligation: the first review of your idea is free
- If we think the idea will not pay back, we say so
- Your idea stays confidential; we can sign an NDA
