Private label food supplements
A supplement sold in the EU, the US and Brazil can need three different formulas and three different labels. Plan for that, or pick one market first.
Private label supplements: what makes this category different
Private label supplements are capsules, powders or gummies made by a contract manufacturer and sold under your brand. The category is regulated as food in most markets, which sounds light until you read the limits: which ingredients are allowed, at what dose, and what you may say about them vary from country to country. A claim that sells the product in one country can be illegal in the next.
So the first decision is the claim, not the capsule. In the EU, a health claim must be on the authorised list in the EU Register. In the US, a structure or function statement needs substantiation, notice to FDA and a mandatory disclaimer. If the proposition depends on a claim you cannot make, the product should change before any money goes into artwork.
We test that logic in the strategy stage, then build the range with assortment planning so that ingredients and factory runs overlap where possible. Consider this page general orientation: a regulatory specialist reviews formula and label for your specific market during the project.
Ways to enter
Fewer active ingredients usually means fewer problems across borders.
Vitamins and minerals
The clearest route in the EU, since permitted forms are harmonised and many claims are already authorised. Competition is strong, so price and channel need honest checking.
Subscription-led brands
Economics rely on repeat purchase. Model churn with the <a href="/brand-margin-calculator/">margin calculator</a> before committing to a large stock position.
What drives the minimum
Factory batch size, label minimums and any custom blend. Stock blends in shared runs lower the entry cost, at the price of less difference.
Rules that shape the product by market
Check these before finalising the formula.
| Market | Framework | Before sale | The usual trap |
|---|---|---|---|
| EU | Directive 2002/46/EC, claims under Regulation 1924/2006, labelling under food information rules | Member States may require notification of each product under Article 10; check every country you sell in | Claims outside the EU Register, and national differences on botanicals |
| US | Dietary supplement rules under the FD&C Act, cGMP guidance for manufacture, packing and labelling | Food facility registration, new dietary ingredient check, and FDA notice when using structure or function claims, with the required disclaimer | Disease claims in marketing, including on social media and in reviews you use |
| Brazil | RDC 243/2018 and IN 28/2018 | Only listed constituents, within minimum and maximum limits; label must read Suplemento Alimentar | A dose that is normal elsewhere may be above the limit |
Supplements are among the most frequently changed rules we track. Treat this as a map for the conversation with your specialist.
Before the first batch is released
Check these in this order, because each depends on the one before.
- Target market chosen, and each ingredient and dose checked against that market’s list
- Claims list reviewed by a specialist, with evidence attached
- Factory checked for food or supplement GMP and for the certificates your buyers ask for
- Label reviewed for required statements, allergens, dose and warnings
- Food business registration, importer role and notifications in place in the country of sale
- Name search and trademark filing, with a plan for what happens if it fails

Frequently asked questions
Do I need approval to sell private label supplements?
In most main markets there is no product-by-product approval, but there are notification, registration and ingredient rules. The EU allows countries to ask for notification, and the US requires facility registration and notice for structure or function claims. Brazil limits the constituents you may use.
Who is responsible if a contract manufacturer makes my supplement?
You remain responsible for what your brand sells. In the US, FDA states that a firm is responsible for ensuring that the supplements it manufactures or distributes are not adulterated or misbranded. A factory certificate helps but does not replace your own checks.
What is the minimum order for private label supplements?
Stock formulas can start at a few hundred units, and custom blends usually need more. Our general working figure across categories is 300–1 000 units per product. Ask the producer to separate powder, capsule and label minimums.
Should a new brand start with supplements at all?
Only if you have a clear customer and can fund compliance, and you accept slower repeat economics. If the plan relies on bold health promises, we will tell you to rethink. Founders often do better with a narrow first range.
